Review of Anti-Human Trafficking Law and a Preview of Anti-Organized Crime Law

Here’s a continuation of the laws I’ve been looking, which these criminal stalkers have obviously violated, actively for over a year and a half, and actually longer for over 3 years: organized crime, human trafficking, romance scam, fraudulent business and fake outsourcing BPO jobs, bribery, murder threat, graft and corruption, terrorism, police and military corruption, and so many crimes that will put them in prison for at least 10 years! Last time, I wrote about a brief review of anti-stalking laws in the Philippines and the US.

Today, I’m writing about anti-organized crime commission (I’m still looking for relevant laws since I couldn’t find them now, it’s a broad law after all), and anti-human trafficking laws. I’ll look into other laws in my succeeding greetings, in God’s will. I’ll first introduce this utter invasion of mental privacy and restriction of mental freedom from brain-computer interfaces that could be inserted without getting consent. Obviously, these decayed criminal stalkers have already thoroughly invaded my privacy and took away from freedom as they were domestically and sexually abusing me 24/7 and doing that even when I went out to coffee shops, Korean restaurants, McDo, public buses, grocery, pathways, and more, actively for over a year and a half, and for longer than 3 years! From that alone, they’re already perpetual criminal stalkers who must be imprisoned for longer sentences, and not be accepted as safe civilians and citizens again for their pathologically mentally sick harmful stalker sexual abuser exploitative opportunistic deceiving decayed selves! They can’t be trusted with anything because they basically don’t have the sense of what is right and what is wrong and they’re perpetual abusers, doing all this criminal stalking domestic and sexual abuse and violent harassment for a very long time already! Sociopaths! Sons of satan, demons, and of iniquity whom Jesus Himself does not know nor recognize!

Yesterday, I was looking into brain-computer interfaces chip brain implant since those decayed criminal stalkers were still harassing me even when I was already rolling to sleep and even when I hadn’t gotten up yet, they’re already harassing me, putting me in domestic abuse in every way possible for such decayed criminals! I’m already sleepy so I don’t respond in my usual “Cursed are you who curse me! You’ll be utterly destroyed, completely burned, and [newly added] blotted out from under heaven! Glory to God! All the abuses you did in hiding will be severely punished in the open! Glory to God! Depart from me satan, in Jesus’ name!” and only said them, but they went on mocking me louder and provoking me, so I sometimes got up and uttered those. That same domestic abuse while I was sleeping was very similar to the ones I got from Sybu Dorm where those decayed low-life drug addict illiterate criminal stalkers in the room below me and in the building next to the dorm, in that severely decayed drug addict-infested and decayed Muslim Mindanao-infested Hippodromo, and in that decayed-brain-decayed-morals criminal stalker-infested TreeWoods Residences, they were non-stop harassing me even while I was rolling to sleep and when I was still not getting up!

They have already illegally installed cameras and mic in all the rooms I stayed in, even in the bathroom, they have also illegally installed spyware in my devices, and following and harassing me everywhere I go, taking away my privacy and freedom, and what else can stop them from taking away my mental privacy and freedom as well? Such decayed criminals, and indeed, they no longer think and function as humans but as demons already! They’ll be prosecuted and utterly destroyed here on earth and blotted out from under heaven and completely burned in hell! Glory to God!

Brain-Computer Interfaces

The Conversation

Brain-computer interfaces could allow soldiers to control weapons with their thoughts and turn off their fear – but the ethics of neurotechnology lags behind the science

• Brain-computer interfaces, or BCI, are technologies that decode and transmit brain signals to an external device to carry out a desired action.
• For example, Neuralink, a company co-founded by Elon Musk, is developing a brain implant for healthy people to potentially communicate wirelessly with anyone with a similar implant and computer setup.
• Embedding a similar type of computer in a soldier’s brain could suppress their fear and anxiety, allowing them to carry out combat missions more efficiently.
• Going one step further, a device equipped with an artificial intelligence system could directly control a soldier’s behavior by predicting what options they would choose in their current situation.
• Enhancing soldiers might create the greatest good by improving a nation’s warfighting abilities, protecting military assets by keeping soldiers remote, and maintaining military readiness.
• This may violate neurorights like mental privacy or mental integrity.
• We find a capability approach compelling because it gives a more robust picture of humanness and respect for human dignity.

Nature

• a mismatch between governance and ethical issues, due to the lack of differentiation between write-in and read-out BCIs. By providing detailed descriptions of the functions and technical approaches of both write-in and read-out BCIs
• BCI technologies, they still pose significant risks to physical safety and privacy, due to the lack of standards and guarantees (Bonaci et al., 2014).
• collect users’ private and sensitive data, leading to potential violations of privacy and a hindrance to users’ right to informed consent (Ienca et al., 2018).
• Read-out BCIs receive and record brain signals, decode them using algorithms and decoders, and convert them to various representations of intentional activities that can be used to control effectors such as prostheses or wheelchairs (Andersen, 2019). Electroencephalogram (EEG) and functional magnetic resonance imaging (fMRI) are technologies that “read” brain signals. Among these, EEG-based BCI technology is more advanced and involves recording brain signals using an array of electrodes placed on the scalp. (McFarland and Wolpaw, 2017)
• Users’ privacy security could be seriously threatened when attackers misuse the private information generated by users’ brains and predict their mental activities, intentions, beliefs, health information, and personality traits (Inzlicht et al., 2009; Chaudhary and Agrawal, 2018). Landau et al. (2020a, 2020b) illustrated that the collection of EEG data via BCI applications constitutes an encroachment upon privacy.
• Exploitation of such information could lead to users being manipulated or coerced into performing malicious behaviors. As BCI technology advances, the ability to monitor users’ thoughts will continue to improve. For instance, researchers have developed a GPT-based language decoder that is similar to the ChatGPT model. This decoder records and decodes brain activity information using non-invasive fMRI, achieving an accuracy rate of up to 82% in speech perception (Tang et al., 2023; Reardon, 2023).
• Informed consent - It is crucial to obtain and provide consent from BCI users before utilizing it and ensure that they comprehend all potential consequences.
• For instance, Chile’s constitutional amendments have paved the way for the safeguarding of citizens’ mental privacy and their freedom of will (Guzmán, 2022). Spain has introduced the “Digital Rights Charter,” which mandates that the utilization of neural technology must ensure each individual’s control over their identity, sovereignty, and self-determination, while also guaranteeing the security and confidentiality of acquired neural data. Moreover, it regulates the deployment of technologies that may impact physical or mental integrity (AOC blog, 2021). France, among others, has issued a “Charter for the responsible development of neurotechnologies.”
• Although there is no immediate security risk, deviations from user-intended actions can occur, and the timeliness and accuracy of the device can be affected, ultimately harming the user.
• However, over-involvement in users’ lives poses a significant risk to privacy and security. Malicious access to, collection, and use of private information can cause harm to individuals and society, with potentially life-threatening results.
• Specific mechanisms to handle recourse cases must be identified, and the right to informed consent protected. Furthermore, vendors must not obtain, store, or share user’s personal privacy information without proper consent.

Presidential Anti-Organized Crime Commission

Some of the Powers and Functions of the Commission:

• Conduct intelligence and counter-intelligence operations to identify government officials and employees, crime syndicates and their cohorts who are involved in criminal activities;
• Cause or direct the immediate arrest, investigation and speedy prosecution of crime syndicates, government officials and employees and their cohorts, with due regard to constitutional processes;
• Enlist the assistance of any department, bureau, office, agency or instrumentality of the Government, including government-owned and/or controlled corporations…in detection and investigation of crimes and prosecution of their perpetrators;
• Subject to the existing laws, grant monetary rewards or incentives to informants giving vital information leading to the successful prosecution of criminal offenders and corrupt government officials;
• Coordinate with the Witness Protection Security and Benefits Program Committee of the Department of Justice to evaluate and assess witnesses who may qualify under the provisions of Republic Act No. 6981, otherwise known as the Witness Protection and Benefit Act;
• Subject to the approval of the President, authorized access to documents, installations and facilities in pursuit of specific crime investigation over government agencies and government-owned or controlled corporations; and
• Recruit civilian personnel and enlist their services for intelligence gathering efforts.

OFFENSES COVERED. The Presidential Anti-Organized Crime Commission shall have the authority to take cognizance of the following crimes:

1. Those committed by organized/syndicated crime groups, including but not limited to gunrunning, illegal logging, robbery/hold-up, kidnapping for ransom, white slavery, illegal recruitment, carnapping, smuggling, piracy, drug trafficking, falsification of land titles and other government forms, large scale swindling, film piracy, counterfeiting and bank frauds;
2. Those considered and punished as heinous crimes under Republic Act No. 7659 (Heinous Crime Law);
3. Those committed by the members of the Philippine National Police and/or the Armed Forces of the Philippines;
4. Those committed by officials and employees of government agencies including government agencies including government-owned and controlled corporations;
5. An organized/syndicated crime group for purposes of this Executive Order means a group of two or more persons collaborating, confederating or mutually helping one another in the commission of any crime and sometimes enjoying the protection of people in the government and public service.

Anti-Human Trafficking Law

Expanded Anti-Trafficking in Persons Act of 2012

Declaration of Policy. – It is hereby declared that the State values the dignity of every human person and guarantees the respect of individual rights. In pursuit of this policy, the State shall give highest priority to the enactment of measures and development of programs that will promote human dignity, protect the people from any threat of violence and exploitation, eliminate trafficking in persons, and mitigate pressures for involuntary migration and servitude of persons, not only to support trafficked persons but more importantly, to ensure their recovery, rehabilitation and reintegration into the mainstream of society.

Trafficking in Persons – refers to the recruitment, obtaining, hiring, providing, offering, transportation, transfer, maintaining, harboring, or receipt of persons with or without the victim’s consent or knowledge, within or across national borders by means of threat, or use of force, or other forms of coercion, abduction, fraud, deception, abuse of power or of position, taking advantage of the vulnerability of the person, or, the giving or receiving of payments or benefits to achieve the consent of a person having control over another person for the purpose of exploitation which includes at a minimum, the exploitation or the prostitution of others or other forms of sexual exploitation, forced labor or services, slavery, servitude or the removal or sale of organs.

Note: These criminal stalkers were more than willing to do their stalking of me because many of them personally knew me, either they were those exploitative decayed relatives, those decayed cut fraud Living Way Ministries, or some UP professors and classmates, former colleagues from teaching, and other friends and acquaintances from elementary to college – and I’ve got an idea of some of them so far (and since I was reading about laws these days, I got to remember the former-teachers-now-“lawyers” and noticed these decayed people near this house whom I initially thought were the cult fraud Val and others – I still think they could be since those Living Way Mandaue were there in TreeWoods and what could stop Living Way Bogo and Danao from continuing their criminal stalking activities here in this house in Bogo – could actually be that Jao and Ling Escalante from Ateneo – Sacred Heart School-Ateneo de Cebu – in addition to those decayed Muslim fake bar reviewees who were staying in the rooms next to me in Hippodromo and were also likely to be following me here as criminal stalkers. I have also identified many of my colleagues from ACT who were making very familiar allusions before, and more than any of my previous colleagues except CRMC, they’re the ones most likely to stalk me.

This cult fraud female or Ling (whoever she is) mocked me “wow” as I was typing this, and I was underlining “the prostitution of others or other forms of sexual exploitation”, where she and other decayed stupid incompetent lawyers were installed here to stalk me and watch my move, especially to counter me in legal ways. This decayed cult fraud or Ling mocked me “luooy (ah, poor and pitiful)” again, and let’s see if they won’t be imprisoned for every single harassment – domestic and sexual abuses - they did against me in hiding, through their criminal stalking activities where they installed disgusting cameras and mic in this house and in all the rooms I stayed in before and even thoroughly harassed me every chance they get, whether I’m taking a bath, peeing, eating, writing, praying, sleeping like extremely stupid, illiterate drug addict out-of-their-mind retarded peeping-tom-sexual-abuser-criminal prison-worthy people! When God’s judgement has been fulfilled, no one will pity them but rather rejoice that judgement has been served in this country that’s infamous for corruption.

Prostitution – refers to any act, transaction, scheme or design involving the use of a person by another, for sexual intercourse or lascivious conduct in exchange for money, profit or any other consideration.

Pornography – refers to any representation, through publication, exhibition, cinematography, indecent shows, information technology, or by whatever means, of a person engaged in real or simulated explicit sexual activities or any representation of the sexual parts of a person for primarily sexual purposes

Note: They have been sexually abusing me actively for over a year and a half, and I have just found out recently how they’ve been doing that for over three years already! Firstly, they put cameras and mic in the houses and rooms I stayed in as well as spyware in my devices; secondly, from that disgusting access, they’ve been monitoring all of my personal activities and selling such details for whatever purposes; thirdly, they’ve been loudly mocking and harassing my every move and making every effort to make that harassment known to me by renting the rooms next to me and having their criminal stalking on a shifting bases there, and even here in Marangog, they’re renting the houses of these decayed exploitative relatives and shouting and other ways of making their harassments towards me known, such as firing guns or firecrackers - be it getting dressed and naked, taking a bath and naked, sleeping, eating, praying, writing for my blog posts, master’s, or writing tests, and everything I do in all the rented places I went to, and now that I’m in my family’s house, they mocked even the interactions we have here; and fourthly, they’ve been following me everywhere and purposefully sitting next to me or getting close to me to make me hear their mocking allusions from their criminal stalker harassment script which they couldn’t have known so consistently if they weren’t stalking me or being part of that disgusting criminal stalker network, be it in the coffee shops, public buses, McDo, Korea restaurant, grocery, pathways, and so many others! For instance, just now, this cult or Muslim near the piggery and those decayed criminal stalkers staying in that rapist sexual abuser locally-listed drug addict Rizal-Jomar – who got a boner on me and rubbed it on my butt when I and my siblings were watching TV when we were in elementary, when my mother was hospitalized – were loudly mocking, harassing, and calling me “boang (crazy)” the entire time while I was making the outline and typing my notes! Let’s see who’s boang when you’re already in prison and severely punished in the open for every harassment you’re doing now, in hiding!

Sex Tourism – refers to a program organized by travel and tourism-related establishments and individuals which consists of tourism packages or activities, utilizing and offering escort and sexual services as enticement for tourists. This includes sexual services and practices offered during rest and recreation periods for members of the military.

Sexual Exploitation – refers to participation by a person in prostitution, pornography or the production of pornography, in exchange for money, profit or any other consideration or where the participation is caused or facilitated by any means of intimidation or threat, use of force, or other forms of coercion, abduction, fraud, deception, debt bondage, abuse of power or of position or of legal process, taking advantage of the vulnerability of the person, or giving or receiving of payments or benefits to achieve the consent of a person having control over another person; or in sexual intercourse or lascivious conduct caused or facilitated by any means as provided in this Act.

Note: I long have suspicion of those criminal stalkers in La Guardia Flats, Sybu Dorm, and Hippodromo rented place beside those police drugging me and offering me for sex for their clients, be it businessmen, politicians, police or military who were very interested on getting a taste of a virgin (this decayed-brain-decayed-morals-decayed-genitals cult or Muslim or Algie’s sister inside his piggery mocked me “duh”) and who supposedly got a high profile boyfriend that obviously gets many decayed clients interested, which expanded their criminal stalking network and added more criminal stalkers!

Acts of Trafficking in Persons. – It shall be unlawful for any person, natural or juridical, to commit any of the following acts:

"(a) To recruit, obtain, hire, provide, offer, transport, transfer, maintain, harbor, or receive a person by any means, including those done under the pretext of domestic or overseas employment or training or apprenticeship, for the purpose of prostitution, pornography, or sexual exploitation;

Note: They’re obviously under fake jobs, be it audio transcription, virtual assistant (VA), outsourcing call center BPO, legal and security, and other fraudulent jobs as front but they’re actually here criminal stalking me and fully enjoying it as they put me in domestic and sexual abuse all the time, using me as their free porn and reacting to me and harassing me whenever whatever way possible for them while they get monthly salary for doing such crimes! All the abuses they did in hiding will be severely punished in the open! Glory to God!

"(b) To introduce or match for money, profit, or material, economic or other consideration, any person or, as provided for under Republic Act No. 6955, any Filipino woman to a foreign national, for marriage for the purpose of acquiring, buying, offering, selling or trading him/her to engage in prostitution, pornography, sexual exploitation, forced labor, slavery, involuntary servitude or debt bondage;

"(c) To offer or contract marriage, real or simulated, for the purpose of acquiring, buying, offering, selling, or trading them to engage in prostitution, pornography, sexual exploitation, forced labor or slavery, involuntary servitude or debt bondage;

"(d) To undertake or organize tours and travel plans consisting of tourism packages or activities for the purpose of utilizing and offering persons for prostitution, pornography or sexual exploitation;

Note: The Cebu City public buses I rode, for instance those to and fro SM-Jmall, were full of those criminal stalkers fake BPO scam agents who were not even hiding their being criminal stalkers as they were purposefully making loud allusions to me and my personal activities inside my room which they wouldn’t have known if they weren’t watching me with their disgusting cameras and mic illegally installed in the rooms I stayed in or part of such huge criminal stalker network. When I went to SM while riding a jeep, another Cebu City bus full of decayed low-life BPO call center agents were mocking me “boang (crazy)”, “gahi (rock-solid)”, “grabi (fierce)”, and other very familiar mockery, showing they’re affiliated to those criminal stalkers in TreeWoods as they were next to the jeep I was riding in, and when I took a video of them, they backed off and let another car overtake them! They also did the same loud mocking allusions when I was traveling from Bogo to Cebu and back when my family pressured me to go home and I decided I’d go back to TreeWoods so they won’t be burdened by all these criminal stalkers who were following and harassing me everywhere I go. I posted their photos on twitter, and the drug addict Ceres driver even nearly crashed the bus to violently harass and threaten me as part of that decayed Duterte lackey’s script that “way makanaug sa bus (no one can get out of the bus)” call! That decayed police from Hippodromo who also resided, transferred, or had office in Visayas Army Training Philippine Army also disgustingly brought his police-in-training there in a Ceres bus, filling that entire bus as if they’re on a training transfer, and they were loudly mocking me showing fully well they knew me, so I took photos and videos of them, and they’re just beside the Ceres bus I rode on my way back to Cebu. This prostitute cult fraud or Ling just mocked me “kaluuoy pud (ah, so poor and pitiful)”, and let’s see if anyone will show that cult sexual abuser mercy when she’s already in prison serving a 10-year sentence!

"(e) To maintain or hire a person to engage in prostitution or pornography;

"(f) To adopt persons by any form of consideration for exploitative purposes or to facilitate the same for purposes of prostitution, pornography, sexual exploitation, forced labor, slavery, involuntary servitude or debt bondage;

"(g) To adopt or facilitate the adoption of persons for the purpose of prostitution, pornography, sexual exploitation, forced labor, slavery, involuntary servitude or debt bondage;

"(h) To recruit, hire, adopt, transport, transfer, obtain, harbor, maintain, provide, offer, receive or abduct a person, by means of threat or use of force, fraud, deceit, violence, coercion, or intimidation for the purpose of removal or sale of organs of said person;

"(i) To recruit, transport, obtain, transfer, harbor, maintain, offer, hire, provide, receive or adopt a child to engage in armed activities in the Philippines or abroad;

Note: Those decayed police who resided in the building next to that rented place in Hippodromo, who were mocking, harassing, domestically and sexually abusing me every day, and who were firing guns on me (loaded or unloaded), were already hugely part, or spearheading, this criminal stalker network, and they followed me in TreeWoods, residing or having office in that Visayas Army Training Philippine Army and Camp Lapu-lapu, did exactly the same pattern of harassment, and also came here in Bogo, paying and hiring all those decayed exploitative drug addict abusive relatives and tambays (unemployed low-life useless people who might be drug addicts and alcoholics) in Marangog to do exactly the same pattern of harassment of firing guns (now masking as firecrackers), playing disco and karaoke, and they were even transferring those police-in-training who were familiarly mocking me as if they’d follow me here in Bogo with their decayed police criminal stalker head from Hippodromo!

"(j) To recruit, transport, transfer, harbor, obtain, maintain, offer, hire, provide or receive a person by means defined in Section 3 of this Act for purposes of forced labor, slavery, debt bondage and involuntary servitude, including a scheme, plan, or pattern intended to cause the person either:

"(1) To believe that if the person did not perform such labor or services, he or she or another person would suffer serious harm or physical restraint; or

"(2) To abuse or threaten the use of law or the legal processes; and

"(k) To recruit, transport, harbor, obtain, transfer, maintain, hire, offer, provide, adopt or receive a child for purposes of exploitation or trading them, including but not limited to, the act of baring and/or selling a child for any consideration or for barter for purposes of exploitation. Trafficking for purposes of exploitation of children shall include:

"(1) All forms of slavery or practices similar to slavery, involuntary servitude, debt bondage and forced labor, including recruitment of children for use in armed conflict;

"(2) The use, procuring or offering of a child for prostitution, for the production of pornography, or for pornographic performances;

"(3) The use, procuring or offering of a child for the production and trafficking of drugs; and

"(4) The use, procuring or offering of a child for illegal activities or work which, by its nature or the circumstances in which it is carried out, is likely to harm their health, safety or morals; and

Note: They were also hiring a “minor” to cover their criminal stalking activity in TreeWoods Residences, who, like so many other criminal stalkers whom I later found out as those decayed cult fraud Living Way Ministries Mandaue from the rooms on my left (1206) and Living Way Ministries Bogo on my right (1202), the male cult fraud members on the rooms above or below me in 14^th floor were loudly mocking, laughing, and harassing my every move, putting me in domestic and sexual abuse 24/7, with such decayed mockery and harassment as “boang (crazy)”, “uwaw (shameful)”, “grabi (fierce)”, “kapoy (tiring)”, “kaluoy (poor and pitiful)”, “eww”, “da (suits you)”, “duh” and so many others, and that “minor” said she was listening to a headset, obviously listening to me as she and the other criminal stalkers had access to the camera and mic they illegally installed inside the room and the spyware they illegally installed in my devices!

"(l) To organize or direct other persons to commit the offenses defined as acts of trafficking under this Act."

Accomplice Liability. – Whoever knowingly aids, abets, cooperates in the execution of the offense by previous or simultaneous acts defined in this Act shall be punished in accordance with the provisions of Section 10(c) of this Act."

Accessories. – Whoever has the knowledge of the commission of the crime, and without having participated therein, either as principal or as accomplices, take part in its commission in any of the following manners:

"(a) By profiting themselves or assisting the offender to profit by the effects of the crime;

"(b) By concealing or destroying the body of the crime or effects or instruments thereof, in order to prevent its discovery;

"(c) By harboring, concealing or assisting in the escape of the principal of the crime, provided the accessory acts with abuse of his or her public functions or is known to be habitually guilty of some other crime.

"Acts defined in this provision shall be punished in accordance with the provision of Section 10(d) as stated thereto."

Note: All these criminal stalkers here are the perpetrators of the crime, and are actually the ones doing the very domestic and sexual abuses 24/7 against me and all the violent harassments they were told through their criminal stalker script! They can’t even deny they’re here, hiding, and not once did they come out to greet me even though I have already found out they are the cult fraud Living Way Ministries members – one of the decayed brainless immature kindergarten-retard way buot cult fraud female member mocked me “luoy (poor and pitiful) – they are the decayed exploitative brainless useless unemployed relatives – one of them just fired a gun or a very loud bang just now! - and that I knew many of them to be previous acquaintances be it from previous work, dorms, school, etc. They’re the main perpetrators – and they’re on a monthly payroll – and it’s certainly abhorrent if they simply present themselves as accomplices and accessories to the crime!

Acts that Promote Trafficking in Persons. – The following acts which promote or facilitate trafficking in persons, shall be unlawful:

• "(b) To produce, print and issue or distribute unissued, tampered or fake counseling certificates, registration stickers, overseas employment certificates or other certificates of any government agency which issues these certificates, decals and such other markers as proof of compliance with government regulatory and pre-departure requirements for the purpose of promoting trafficking in persons
• Qualified Trafficking in Persons. – Violations of Section 4 of this Act shall be considered as qualified trafficking:
  • When the offender is a spouse, an ascendant, parent, sibling, guardian or a person who exercises authority over the trafficked person or when the offense is committed by a public officer or employee;
  • "(f) When the offender is a member of the military or law enforcement agencies;
  • "(g) When by reason or on occasion of the act of trafficking in persons, the offended party dies, becomes insane, suffers mutilation or is afflicted with Human Immunodeficiency Virus (HIV) or the Acquired Immune Deficiency Syndrome (AIDS);
  • "(h) When the offender commits one or more violations of Section 4 over a period of sixty (60) or more days, whether those days are continuous or not; and
  • "(i) When the offender directs or through another manages the trafficking victim in carrying out the exploitative purpose of trafficking."

"SEC. 10. Penalties and Sanctions. – The following penalties and sanctions are hereby established for the offenses enumerated in this Act:

"(a) Any person found guilty of committing any of the acts enumerated in Section 4 shall suffer the penalty of imprisonment of twenty (20) years and a fine of not less than One million pesos (P1,000,000.00) but not more than Two million pesos (P2,000,000.00);

"(b) Any person found guilty of committing any of the acts enumerated in Section 4-A of this Act shall suffer the penalty of imprisonment of fifteen (15) years and a fine of not less than Five hundred thousand pesos (P500,000.00) but not more than One million pesos (P1,000,000.00);

"(c) Any person found guilty of Section 4-B of this Act shall suffer the penalty of imprisonment of fifteen (15) years and a fine of not less than Five hundred thousand pesos (P500,000.00) but not more than One million pesos (P1,000,000.00);

"In every case, conviction shall cause and carry the automatic revocation of the license or registration of the recruitment agency involved in trafficking. The license of a recruitment agency which trafficked a child shall be automatically revoked.

"(d) Any person found, guilty of committing any of the acts enumerated in Section 5 shall suffer the penalty of imprisonment of fifteen (15) years and a fine of not less than Five hundred thousand pesos (P500,000.00) but not more than One million pesos (P1,000,000.00);

"(e) Any person found guilty of qualified trafficking under Section 6 shall suffer the penalty of life imprisonment and a fine of not less than Two million pesos (P2,000,000.00) but not more than Five million pesos (P5,000,000.00);

"(f) Any person who violates Section 7 hereof shall suffer the penalty of imprisonment of six (6) years and a fine of not less than Five hundred thousand pesos (P500,000.00) but not more than One million pesos (P1,000,000.00);

"(g) If the offender is a corporation, partnership, association, club, establishment or any juridical person, the penalty shall be imposed upon the owner, president, partner, manager, and/or any responsible officer who participated in the commission of the crime or who shall have knowingly permitted or failed to prevent its commission;

"(h) The registration with the Securities and Exchange Commission (SEC) and license to operate of the erring agency, corporation, association, religious group, tour or travel agent, club or establishment, or any place of entertainment shall be cancelled and revoked permanently. The owner, president, partner or manager thereof shall not be allowed to operate similar establishments in a different name;

"(i) If the offender is a foreigner, he or she shall be immediately deported after serving his or her sentence and be barred permanently from entering the country;

"(j) Any employee or official of government agencies who shall issue or approve the issuance of travel exit clearances, passports, registration certificates, counseling certificates, marriage license, and other similar documents to persons, whether juridical or natural, recruitment agencies, establishments or other individuals or groups, who fail to observe the prescribed procedures and the requirement as provided for by laws, rules and regulations, shall be held administratively liable, without prejudice to criminal liability under this Act. The concerned government official or employee shall, upon conviction, be dismissed from the service and be barred permanently to hold public office. His or her retirement and other benefits shall likewise be forfeited; and

"(k) Conviction, by final judgment of the adopter for any offense under this Act shall result in the immediate rescission of the decree of adoption."

"SEC. 11. Use of Trafficked Persons. – Any person who buys or engages the services of a trafficked person for prostitution shall be penalized with the following: Provided, That the Probation Law (Presidential Decree No. 968) shall not apply:

"(a) Prision Correccional in its maximum period to prision mayor or six (6) years to twelve (12) years imprisonment and a fine of not less than Fifty thousand pesos (P50,000.00) but not more than One hundred thousand pesos (P100,000.00): Provided, however, That the following acts shall be exempted thereto:

"(1) If an offense under paragraph (a) involves sexual intercourse or lascivious conduct with a child, the penalty shall be reclusion temporal in its medium period to reclusion perpetua or seventeen (17) years to forty (40) years imprisonment and a fine of not less than Five hundred thousand pesos (P500,000.00) but not more than One million pesos (P1,000,000.00);

"(2) If an offense under paragraph (a) involves carnal knowledge of, or sexual intercourse with, a male or female trafficking victim and also involves the use of force or intimidation, to a victim deprived of reason or to an unconscious victim, or a victim under twelve (12) years of age, instead of the penalty prescribed in the subparagraph above the penalty shall be a fine of not less than One million pesos (P1,000,000.00) but not more than Five million pesos (P5,000,000.00) and imprisonment of reclusion perpetua or forty (40) years imprisonment with no possibility of parole; except that if a person violating paragraph (a) of this section knows the person that provided prostitution services is in fact a victim of trafficking, the offender shall not be likewise penalized under this section but under Section 10 as a person violating Section 4; and if in committing such an offense, the offender also knows a qualifying circumstance for trafficking, the offender shall be penalized under Section 10 for qualified trafficking. If in violating this section the offender also violates Section 4, the offender shall be penalized under Section 10 and, if applicable, for qualified trafficking instead of under this section;

"(b) Deportation. – If a foreigner commits any offense described by paragraph (1) or (2) of this section or violates any pertinent provision of this Act as an accomplice or accessory to, or by attempting any such offense, he or she shall be immediately deported after serving his or her sentence and be barred permanently from entering the country; and

"(c) Public Official. – If the offender is a public official, he or she shall be dismissed from service and shall suffer perpetual absolute disqualification to hold public, office, in addition to any imprisonment or fine received pursuant to any other provision of this Act."
